All processes relating to complaints, mediation, preliminary investigations, and disciplinary hearings derive their legal authority entirely from this Act. When a complaint is lodged against an ASET member, the Act provides mechanisms for alternative dispute resolution, such as mediation, to resolve less severe conflicts between members or clients amicably.
However, even if a matter is settled privately through mediation, the regulatory body retains its paramount duty to protect the public. Under Section 47 of the EGPA, the Investigative Committee reserves the statutory right to proceed with a preliminary investigation anyway, to ensure that no systemic incompetence, severe ethical breaches, or ongoing threats to public safety are swept under the rug by a private settlement. The Code of Ethics and OHS Acts do not contain these specific procedural mechanisms for ASET discipline.

The designations of Certified Engineering Technologist (C.E.T.) and Certified Technician (C.Tech.) are legally protected titles under the Engineering and Geoscience Professions Act (EGPA). The physical certificates issued by ASET-specifically the primary Certificate of Registration (often a wall certificate) and the Annual Certificate (or digital equivalent proving current year dues and compliance)
-remain the legal property of the Association, not the individual member. They serve as public declarations of a member's current competency and legal right to practice. When a member's registration is cancelled-whether due to voluntary resignation, non-payment of dues, or as a result of disciplinary action-they immediately lose the legal right to use those titles and practice under that regulated scope. To prevent public deception or the fraudulent use of professional credentials by someone no longer bound by the ASET Code of Ethics, ASET bylaws require that both the Certificate of Registration and the Annual Certificate must be immediately surrendered and returned to the Registrar.

Under the ASET Code of Ethics, members must only provide professional opinions founded upon adequate knowledge and honest conviction, and they must hold paramount the safety of the public.
Approving a deficiency report for a public building that the member knows is inaccurate is an act of professional fraud. By signing or approving it, the member takes legal and professional responsibility for those inaccuracies, potentially allowing dangerous structural or safety flaws to go uncorrected.
Client pressure and executive orders never supersede a professional's ethical obligation to tell the truth and protect the public. While discussing it with the original compiler (Option C) might be a subsequent step, the immediate appropriate response to the executive's direct order is to refuse. The member must explicitly advise the executive that they cannot and will not approve the report because the inaccurate information compromises public safety and violates professional ethical standards.

In Canadian employment law, "just cause" is the legal standard that an employer must meet to terminate an employee without providing notice or severance pay. Termination for just cause occurs when an employee fundamentally breaches the core obligations of their employment contract. This breach must be severe enough to irreparably destroy the employment relationship and the trust between the employer and the employee.
